Description
Justification for other than full and open competition for a sole-source contract modification to Tutor Perini Corporation-Nan Inc. A Joint Venture (TPC-NAN JV). This action is for critical and immediate emergency waterfront stabilization repairs to the Glass Breakwater at Apra Harbor, Guam, to address damage sustained from Typhoon Bavi and prevent further deterioration of this critical infrastructure.
The modification, valued at $21,000,000, covers the procurement and placement of an additional 27,000 tons of armor stone. The statutory authority permitting this action is 10 U.S.C. § 3406(c) as implemented by FAR 16.507-6(b)(1); the agency's need for these services is of such unusual and compelling urgency that providing a fair opportunity would result in unacceptable delays.
