JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

1. Contracting Activity:

2. Description of Action: The proposed action is for a Firm-Fixed Price (FFP) Task Order (TO) that will be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) Contract Number NNG15SC67B with Cynergy Professional Systems to provide Veterans Affairs Medical Center (VAMC) Las Vegas with Motorola APX N30 Radios, AXS Dispatch Consoles, Radio Programming and the installation of the consoles. 3. Description of the Supplies or Services: The proposed action is to provide APX N30 Radios, AXS Dispatch Consoles, Radio Programming and the installation of the consoles at the VA Southern Nevada Healthcare System, 6900 N. Pecos Road, North Las Vegas, NV 89086. The Contractor shall also provide all additional equipment, labor, supervision, and materials required to complete the project along with one year of maintenance support. Once installation and configuration are complete, two one-hour training sessions will be conducted on the AXS operation. The total estimated value of the proposed action is

Statutory Authority: The statutory authority permitting an exception to fair opportunity for this action is 38 U.S.C. 8127(c), known as the Veterans First Contracting Program which provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). This authority is pursuant to the exception to the fair opportunity process at Revolutionary FAR Overhaul VA Deviation 16.507-6(b)(5), which states that “For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.”
5. Rationale Supporting Use of Authority Cited Above: The proposed source is Cynergy Professional Systems, 23187 La Cadena Drive, Laguna Hills, CA 92653. Cynergy Professional Systems is a Service-Disabled Veteran-Owned Small Business (SDVOSB) that is fully authorized and certified to provide Motorola Solutions’ public safety communications equipment, software, and integration services.
