Statutory authority permitting other than full and open competition The authority to enter into a contract for this effort without full and open competition is Federal Acquisition Regulation Overhaul (RFO) Subpart 6.1. Specifically, RFO 6.103-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”

Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited

The type, model and color of has been previously installed by Arches National Park at other locations in the area. Arches National Park requested that the same type, model and color of delineator to be installed as a part of this project to maintain consistency throughout the National Park. Use of the same delineator will also simplify maintenance for Arches National Park in regards to stocking replacement parts.

The Justification for Other than Full and Open Competition will be posted with the solicitation as required by FAR 5.102(a)(6).

The FHWA will ensure that all costs associated with the proposed contract are fair and reasonable. The FHWA will perform a thorough analysis of the Offeror’s bid to substantiate this determination.
