DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Updated IAW Revolutionary FAR Overhaul 13 and DOI-AAAP-F013 Pursuant to Federal Acquisition Regulation (FAR) 13.101(b), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from a single source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). FAR Part 13 procedures may only be used if there are no commercial products or commercial services that can satisfy the agency’s needs and the supplies or services are not available from a required source.
1. Agency and Contracting Activity.
The Department of Interior (DOI), Bureau of Reclamation (BOR), Interior Region 10, California – Great Basin (CGB), Construction Acquisitions Office located in Sacramento, California.
2.

Name and Address of Single Source.
Souza Construction, Inc.
586 S. Farmersville, Blvd
Farmersville, CA 93223

3. Description of Supplies/Services and Estimated Cost. The construction work involves the complete removal of the existing failed HVAC system and installation of a replacement system consisting of either one 12.5 ton HVAC unit or a comparable commercial-grade HVAC system. The replacement unit is to be determined and will be located inside the building’s HVAC room. The contractor provided an estimated cost of $86,267.26.
4. Description of Circumstances, including why only one source is reasonably available. IAW FAR 13.101-1(b), only one source will be solicited because of the urgency of this requirement. The work must be completed as soon as possible. The existing 12.5-ton HVAC unit serving approximately 2,700 sq ft of office space is no longer functioning properly and must be replaced to ensure safe working conditions for up to 13 employees. Summer temperatures in Friant, CA routinely exceed safe indoor limits, creating immediate risks of heat-related illness and directly affecting dam staffing and operational readiness, as discussed in prior meetings and email exchanges. Additionally, a recent service visit identified clear signs of system degradation, further reinforcing the need for prompt replacement to maintain safe and reliable working conditions.
