1.0 General Requirements for Spill Contingency Plans – 40 CFR 109.5 and 40 CFR 112.7 and Appendix E to Part 112
Fort Drum is required to prepare and implement a Spill Prevention, Control, and Countermeasure (SPCC) Plan by 40 CFR 112 and a spill prevention report by 6 NYCRR 598.1(k). Fort Drum has an SPCC Plan and a Hazardous Substance Spill and Contingency Plan as separate documents to meet these requirements, respectively. The SPCC Plan and Hazardous Substance Spill and Contingency Plan shall be used concurrently when required with this Installation Spill Contingency Plan (ISCP). 1.1 General – 40 CFR 112.7(a) (5), 112.7(d) (1), 112.7(k) (2) (ii) The SPCC Plan regulations in 40 CFR 112 [specifically 112.7(a)(5), 112.7(d)(1), 112.7(k)(2)(ii)] include requirements for, “describing procedures … use(d) when a discharge occurs in a way that will make them readily useable in an emergency” and oil spill contingency plans following the provisions of 40 CFR 109. The first part of the requirement is met by the SOP Quick List, in Appendix G. The second requirement is much more detailed and each facet of it is met by the remainder of this ISCP. 1.2 Specific Requirements – 40 CFR 109.5
