MEMORANDUM FOR

to file RFQ 15B41826Q00000005

FROM:

Carl Livingston, Contract Specialist

SUBJECT:

Second (2) Amendment to Solicitation 15B41826Q00000005 – Updated NAICS code for the requirement

Good afternoon,

It has been brought to my attention that the NAICS code (423720) listed in the current solicitation is prohibited. The U.S. Small Business Administration (SBA) regulation 13 C.F.R. § 121.402(b)(2) bars the use of wholesale trade and retail trade NAICS codes in federal contracting.

The Bureau of Prisons (BOP) is a federal agency, so any BOP‑related contract must comply with SBA’s NAICS restrictions. If a BOP solicitation or contract lists a NAICS code starting with 42, it would be non‑compliant.

As a result, a new NAICS code will be issued for solicitation 15B41826Q00000005. This solicitation is restricted, 100% Small Business set aside. The North American Industrial Classification System (NAICS) code applicable to this requirement is (333415).

The SBA Non‑Manufacturer Rule outlines the circumstances under which a small business may provide products it did not manufacture for set‑aside federal contracts. This rule does not apply to the items included in this solicitation. To qualify for award under SBA small‑business requirements, the vendor supplying the quotation must manufacture at least 51 percent of the total value of the products being supplied.

After reviewing the updated documents, if you have any additional questions, please feel free to reach out, and I will provide clarification as appropriate. Please note that we will only address inquiries submitted by interested parties who meet all solicitation requirements. Any previously submitted questions that remain unanswered prior to this amendment will not receive a response unless resubmitted. Please ensure you review the solicitation documents thoroughly to confirm that your question has not already been addressed.

The due date for submitting quotations is November 02, 2026, before 11:00 AM EST. As always, all available information and updates will be posted on SAM.gov. Please submit all quotations to [email protected].
